ACCEPTANCE OF TERMS
By downloading, installing, or using Rollup ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
DESCRIPTION OF SERVICE
Rollup is a mobile application that allows you to:
- Create personalized photo Rollups (daily, monthly, and yearly recaps)
- Organize and manage your photo library
- View statistics about your photo collection
- Generate shareable content from your photos
The App processes your photos entirely on your device. We do not upload, store, or transmit your photos to external servers.
ELIGIBILITY
You must be at least 13 years old to use Rollup. By using the App, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.
PHOTO LIBRARY ACCESS
To use Rollup, you must grant the App access to your photo library. You understand that:
- The App requires photo library access to function
- All photo processing occurs on your device
- You can revoke access at any time through iOS Settings
- Revoking access will limit App functionality
USER CONTENT
Your Photos: You retain all ownership rights to your photos. By using the App, you grant Rollup a limited, non-exclusive license to access and process your photos solely for the purpose of providing the App's features. This license terminates when you delete the App or revoke photo library access.
Generated Content: Rollups, statistics, and other content generated by the App are created from your photos. You own all rights to this generated content and may share it as you choose.
SUBSCRIPTIONS AND PAYMENTS
Pro Subscription: Rollup offers optional Pro subscriptions that unlock additional features. Subscriptions are managed through Apple's App Store and are subject to Apple's terms and conditions.
Payment: All payments are processed by Apple. We do not have access to your payment information.
Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions through your Apple ID settings.
Refunds: Refund requests must be submitted to Apple through the App Store. We do not process refunds directly.
PROHIBITED USES
You agree not to:
- Use the App for any illegal purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App's functionality
- Use the App to violate any third-party rights
- Share content that is illegal, harmful, or violates others' rights
INTELLECTUAL PROPERTY
The App and its original content, features, and functionality are owned by Rollup and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works of the App without our express written permission.
DISCLAIMERS
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The App will be uninterrupted or error-free
- Defects will be corrected
- The App is free of viruses or other harmful components
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROLLUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.
Our total liability for any claims arising from your use of the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $10, whichever is greater.
DATA AND PRIVACY
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
TERMINATION
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.
You may stop using the App at any time by deleting it from your device.
CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the App Store listing
- Updating the "Last Updated" date at the top of these Terms
Your continued use of the App after changes become effective constitutes acceptance of the modified Terms.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Rollup operates, without regard to its conflict of law provisions.
SEVERABILITY
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rollup regarding your use of the App and supersede all prior agreements and understandings.
